mmm, the forum won't let me post the contents of this link TRANSPORTATION CODE CHAPTER 546. OPERATION OF AUTHORIZED EMERGENCY VEHICLES AND CERTAIN OTHER VEHICLES

but basically they don't define an unmarked car outright just times when an emergency vehicle doesn't have to display lights or sirens. The "stealth" cars we have in Houston that are marked with reflective markings only are considered marked cars but I haven't heard of any initiating a pursuit yet. Even if they were challenged in court I suspect they would fall under the same category as slicktops.

In short, an unmarked car (or officer in his private car) cannot initiate a pursuit unless he thinks a felony has been committed. Of course he can follow a violator, call in his location and is free to put on the lights as well but cannot initiate a pursuit until marked units join in. Thats why it's good to have a fast car.

The transportation (545.421) code also states:

FLEEING OR ATTEMPTING TO ELUDE POLICE
OFFICER; OFFENSE. (a) A person commits an offense if the person operates a motor vehicle and wilfully fails or refuses to bring the vehicle to a stop or flees, or attempts to elude, a pursuing police vehicle when given a visual or audible signal to bring the vehicle to a stop.
(b) A signal under this section that is given by a police officer pursuing a vehicle may be by hand, voice, emergency light, or siren. The officer giving the signal must be in uniform and prominently display the officer's badge of office. The officer's vehicle must be appropriately marked as an official police vehicle.
(c) Except as provided by Subsection (d), an offense under this section is a Class B misdemeanor.
(d) An offense under this section is a Class A misdemeanor if the person, during the commission of the offense, recklessly engages in conduct that places another in imminent danger of serious bodily injury.

Bold added by me. We come back to why I asked about marked vs. unmarked. From what I understand, the "appropriate markings" is left to interpretation of the prosecutor and judge. If they have strobes and sirens (without "appropriate markings"), you can probably bet they also have cameras.

From what I understand of the Texas laws, pursuit of speeders is largely handled on a regional basis. Houston cops may not pursue while small town cops will. And if you run from a slick-top that has only flashing lights and siren, you better hope they don't see your license plate, have an air unit available, or otherwise be in a bad mood.

Don't get me wrong, I would probably have done the exact same thing. I was just wondering where you were getting your information on pursuit policy.

nope. sold it to a postal worker that bore a striking resemblence to the Rock. Frankly, right now the way business is I'm really thinking of holding on to my cash for awhile. Maybe buy another Scuby.

42 right? I'm about to be 43. Which after a week in Monument CO elevation @ 7100 feet I'm feeling every day of. Hiked up to Pikes Peak Wednesday and back down on Wednesday which like to have killed me. I will not ever do that again.

Right now I'm driving my Jeep Wrangler. Strictly PSL. It's a great off road truck but terrible on the highway. Still shopping for a new lab car.
