TRANSPORTATION CODE CHAPTER 546. OPERATION OF AUTHORIZED EMERGENCY VEHICLES AND CERTAIN OTHER VEHICLES

OFFICER; OFFENSE. (a) A person commits an offense if the person operates a motor vehicle and wilfully fails or refuses to bring the vehicle to a stop or flees, or attempts to elude, a pursuing police vehicle when given a visual or audible signal to bring the vehicle to a stop.
(b) A signal under this section that is given by a police officer pursuing a vehicle may be by hand, voice, emergency light, or siren. The officer giving the signal must be in uniform and prominently display the officer's badge of office. The officer's vehicle must be appropriately marked as an official police vehicle.
(c) Except as provided by Subsection (d), an offense under this section is a Class B misdemeanor.
(d) An offense under this section is a Class A misdemeanor if the person, during the commission of the offense, recklessly engages in conduct that places another in imminent danger of serious bodily injury.

ProSpeeder, I have seen HPD driving a very similar setup, they have a few of those chargers that you can barely see police written on....

And of course the unmarked ones as well.

I didn't post the pix last night but I did get a shot of one of the Harris County Deputies driving a completely unmarked car. It is indeed a full patrol model with laptop, shotgun, passenger cage, lights and a push bar. Not exactly the stealthiest thing I've ever seen but definitely not marked in any way.

I think I should let everyone know what my lawyer said about that Transportation Code...

All it means is you can not be sited if you flee a unmarked patrol car with no lights and the officer is in street clothes and the badge is not shown fully.

In a nutshell unmarked police cars are not against the TXDOT code...

I hope I didn't suggest unmarked police cars are against the TXDOT code.
Only that they can't chase you down if you take off on them. For that reason they don't run traffic duty alone.
